It isn't exactly a loophole. He has to have the senate's approval to sign it and even then Article 6 of the constitution states that no treaty over rides the constitution.

That said, he will likely put his worthless signature on it without approval and attempt to enforce it illegally. He has already said he doesn't care about the constitution and will disregard it.
