Well, based on what I've found so far, it's been in effect for quite some time. The ACLU did a piece on it in 2008

You may be right. I guess more people are being stopped/detained/questioned and having their electronics analyzed and therefore this is coming to light. People are now telling their stories.

Border patrol has had similar powers for years. Maybe not the 100 miles part though
